If someone did come up with a "dubious" way to stop Brexit then ERG et al could also use the courts to decide.  Just because it's "dubious" does not mean it's inherently unconstitutional and if the UK actually had a written constitution then there would be no need for this ( like avoiding the need to get a court order to make an advisory referendum legally binding on the govt) .  You know full well that what BJ has done is unprecedented (whether it's unconstitutional we'll soon find out) and Bercow has not pulled his punches on the matter. This is a good post but I have to quibble with the bit in bold. The US has a written constitution and we argue about it and its meaning in court all the time. Constitutional challenges are all over the place, and every Supreme Court session will have at least a few, to say nothing of all the federal circuit courts where constitutional interpretation is argued, and state appeal and supreme courts.

 

What the written constitution does potentially do is give a little more clarity as to what the result of any of these arguments will be (until they turn out the opposite way you thought would make sense, which happens way too much). That said, as it stands, who knows how this one is going to go, since we have nothing written to guide us.

Usually whoever loses as far as I know, the remainers have crowd funded their costs seemingly, whilst if the government lose I'd imagine it'll be the tax payer who will foot the bill.

 

 

I see former PM John Major has backed Gina Miller in her court case against the proroguing of Parliament.

Remember this is the very same John Major who himself prorogued parliament in 1997 for 19 days in an attempt to prevent awkward questions about the 'cash for questions' scandal, seems it was alright when he did it but it's an outrage when someone else does the same thing, oh the hypocrisy.

The politicians focus should be on stopping No Deal. Anything else is a sideshow created by Cummings.

 

Rumours that a big advertising blitz on how to "Get Ready"* for a no deal Brexit next week.

Imagine a campaign akin to a war footing on a wholly avoidable scenario,  yet muppets up and down the country are lapping this up.

 

 

*Assume advice on stockpiling rather than listening to New Order's 2001 comeback album

You can’t have it both ways, you can’t criticise them for crashing ahead with their own agenda and then in the same breath criticise one of them for rejecting this own party for the good of the country.

All, no  , not all.

 

This current government are beyond the pale when it comes  to laying , cheating , and being hypocritical  towards Brexit , welfare cut justifications, NHS spending .

 

And public cuts , Austerity and even under May who said all those child abuse files involving high ranking individuals within politics are LOST.

 

There is no way they would  lose such files on joe bloggs or anyone from the public.

 

Even the current PM was SACKED from his position before he came PM as was the  same with the current  Home secretary Priti Patel who was  sacked   by May  in 2017 she was  caught out  when she was involved in a political scandal, involving unauthorised meetings with the Israeli government, ending her time as International Development Secretary.

 

Then  under another liar and very slippery character namely  our current PM Boris Johnson's  she assumed the role of Home Secretary . Birds of a feather flocking  together is an apt description of this present Tory cabinet.

Had her escorted out of Downing St by police and everything.

The suspension of parliament feels like a Trump tactic. It may or not be constitutional but it definitely changes to focus of attention and wrong foots the opposition.

So this is just a reminder that the government has 30 days to come with an alternative to the backstop that will do an acceptable job in preventing a hard border in Ireland.

That was discussed at a meeting on 21 August so we are 9 days into that 30 day period. Makes you wonder what progress is being made towards that target?

Boris has openly said that this is all just a tactic to force the EU into dropping the backstop on the night of the 31st Oct.

Which isn't going to happen.

Brexit will mean asking the USA for a trade deal and opening up our NHS to Trump and the American corporate pharma businesses (he already said so on live TV). Well done tories.

Why on earth would a trade deal result in these charges in the UK?  And what does "prescribed for" a hip operation, knee replacement or cataract operation even mean?

Myself, I've always been under the impression, those folk who run the country, the political elite.. actually couldn't run a f-ing bath. They have hoodwinked everyone for years as everything's already in place... but now they actually have to make decisions regarding Brexit... political elite + decisions = f-ing shambles.

You can't just break the rules and expect your opponents to obey them.

Any MP can bring a bill forward.

Depending on the order of business or the Speaker's allowance, it gets heard.

The House as a whole then votes.

If it passes, it becomes binding law for the entire nation.

 

That's how it works.

MPs cannot pass binding primary legislation without the consent of ministers which they will not get.

The Prime Minister will be well within his rights to refuse royal consent which I expect him to.

If you don't like it then call a vote of no confidence.
