Yep, here's an example from a few weeks ago, he stabbed the guy twice, killing him, but was found not guilty of murder. He got six months for criminally negligent homicide instead.

It's also been used as a defence in Australia, New Zealand and here in the UK (known as the Portsmouth defence), although I believe it's getting less and less common thankfully. 

I'd be surprised if it hasn't been used elsewhere tbh but that's all I know about it.

It's rooted in common law, which can be overturned by the courts in certain circumstances. It's extremely subjective, and in this case was decided by jury, which makes it even more subjective of course.

 

Suffice to say there's old case law that underpins this, and that can be used to argue in court until either the courts reverse stare decisis or a legislature steps in and passes an explicit law to ban it. It's only been used successfully a handful of times this century (https://en.wikipedia.org/wiki/Gay_panic_defense), but of course every time it's successfully used is a travesty.

Have to admit, I went to Costa the other day and was disappointed I didn't get my coffee in a rainbow takeaway cup. :lol:

 

Must have just been certain branches in Edinburgh doing it!

I used to love rainbows, I just did. Now I feel I have to or I am in some way homophobic. I did get the sense walking through town on Saturday that most shops that were displaying the rainbow in their windows were doing it more out of fear of being labelled than anything else. Very sad.
