It's rooted in common law, which can be overturned by the courts in certain circumstances. It's extremely subjective, and in this case was decided by jury, which makes it even more subjective of course. Suffice to say there's old case law that underpins this, and that can be used to argue in court until either the courts reverse stare decisis or a legislature steps in and passes an explicit law to ban it. It's only been used successfully a handful of times this century (https://en.wikipedia.org/wiki/Gay_panic_defense), but of course every time it's successfully used is a travesty.
