I used to think the Huns had cheated their way to all these trophies but having read this explanation from one of the people I've had my opinion changes

Thats is a damning ouch extract.

 

I still think until Sandy Bryson's view is challenged / over turned there will always be a (non) trophy stripping get out.

As far as is known only two clubs in Scotland operated EBT's to pay employees, Celtic and Rangers.

Celtic as far as we know, when investigated agreed to pay the tax due, or a settlement amount agreed by HMRC.

Rangers didn't and further investigations have found that the way they operated their EBT schemes was in a way which meant they weren't EBT's but tax evasion. They also had incorrectly registered players and their remuneration arrangements.

 

From memory, and can't remember the player's name, but Celtic didn't operate an EBT scheme, they signed a player from an English club who already had an EBT and thought it should continue. When Celtic discovered this they approached HMRC to settle it, at, I believe, their own expense. This matter has been debated ever since the RFC scandal came to light and, rather than provide a dubious 'whataboutery' defence, shows Celtic up in a better light than is intended by those who raise it.

 

I'm afraid I'm sketchy on the exact details though expect someone like FF can fill us in more precisely on what happened.

Loads of EPL clubs used them.  Loads in every walk of business have used them.

 

But if I'm honest, that's the bit that gets me.  When you see the penalties applied to others for minor non-registration failures.  Our supposed governing bodies are a joke.

 

Can't be bothered with hindsight.  They're still digging their own graves spectacularly well over at Ibrox.

 

As has been mentioned numerous times on here over the last few days it's not that Rangers used EBT's that's the problem, it's the way they used the EBT, the way theirs were set up was to deliberately avoid paying tax on the money paid through the EBT to the players.  Out of the thousands of companies which used EBT's and probably still do the vast majority use/used them correctly and paid tax if it were due it is only relatively a few who abused their use for tax evasion/avoidance, Rangers being one of them.

No there isn't. We spent other people's money that wasn't actually there. They spent money that wasn't actually there as well. Makes no difference just because you can lay your hands on it.

There was no deliberate act in our part to cheat anyone, yes mistakes were made Romanov got things wrong, in the end the banking crisis was too much for him that's what killed Romanov financially and ultimately us.

 

FF can correct or give accurate figures but I believe our overall debt levels when we entered administration were around the same level or not much more than they were pre Romanov.

Our debt was also accumulated before Romanov in an attempt to keep pace with Sevco.

There is a little information in Celtic's accounts re the Juninho EBT.  Celtic set up their own EBT, rather than contribute to an existing one.  From the 2005 Accounts: "The Celtic plc Employee Benefit Trust was established during 2005 to provide benefits to certain employees, former employees or their families or any charity"

 

The amount contributed in 2005 was ?765K.  There were no contributions made in 2006 and there was no mention of the EBT in subsequent years Accounts. 

 

There is no specific mention of tax being paid in relation to the EBT, but in the 2006 accounts, there may be a clue under "Exceptional Operating Expenses" which includes "a provision of ?0.40m in respect of a provision for impairment of intangible fixed assets".  Players contracts are accounted for as intangible fixed assets and ?0.4M would be consistent with tax and NIC on earnings of ?765K. The numbers might just be coincidence, but the timing and amounts involved look about right.

The laptop loyal have been hard at work the last few days at their usual dissembly and deflection.

 

as far as Hearts are concerned and without going into the detail of whether Vlad actually added to the clubs debt level we went bust, received a punishment for our insolvency,, and are now emerging on the other side. I am very sure the contracts of the Kaunus loanees were investigated by the footballing authorities and no registration irregularities were found.

 

As far as RFC are concerned they went bust and were unable to emerge from insolvency. Ignoring all the arguments about whether the current entity at Ibrox is a continuation of the same club they got dealt with as far as their insolvency goes. Additionally though they witheld, for obvious reasons, any of the documentation regarding the 'contracts' they formed with their players from the footballing authorities. That got looked at and dealt with on the basis that their tax arrangements with their players were lawful. Now however it appears, pending appeal, that this was not so and therefore should be dealt with by the SPFL/SFA.

 

A simple holding statement from Doncaster saying they will re examine the outcome of the Nimmo Smith enquiry pending the final outcome of any appeal should do for now.

Think net debt in 2003 was ?17.5m ish not sure about 2004 but suspect around 19-20m.

 

What we shouldn't forget is that when we entered administration the main debtor was ukio but there were others including hmrc that were owed cash and I think the total debt was way north of ?25m, if I recall correctly it was approaching ?30m but FF will know better than me.

Our "Net debt" was ?21.526M in 2005 and ?26.223M in 2013

 

As ever with Net Debt, there is devil in the detail:

The 2005 figure was mostly made up of an overdraft of ?4.7M, a bank loan of of ?12.3M and Convertible loan stock (SMG) of ?4.6M

The 2013 figure was made up of ?15.6M (Ukio), ?8.3M (UBIG) and sundry other items

 

The "like for like" part was probably ?21.5M in 2005 against ?23.9M in 2013

 

 

When you go into administration all sort of debts which may have been managed normally crystalise in full, e.g. The lease for Riccarton which had 16 years to run crystalised into a ?5M debt, hence the apparent ?30+M overall debt figure which came up during Admin.

I'm currently about 50/50 whether or not it will be reconvened. It will ultimately be up to the clubs, possibly influenced by their supports, as was the case in 2012 re "Rangers" admission to Division 3 in 2012.  The immediate action will (rightly) be to delay doing anything before the appeals process comes to an end. That might be at the start of December or a year or two down the road.

 

The SFA and SPFL could also come under some pressure from external corruption investigations that are currently ongoing or likely to proceed, in such a way that they are forced to put their own house in order, e.g. FIFA, UEFA and the IAAF.  I think that aspect is less likely, as it would mean that Regan, Doncaster, Ogilvie and others could be implicated.

It was obviously the net debt and like for like figures I was looking at and comparing. As you say though any outstanding commitments all come together in administration and push the actual admin debt figure higher.

Another option is that Celtic shareholders kick up a stink and raise a resolution at their AGM (as they have done over the granting of a licence to Rangers for European football when

It's the 'Scottish football has suffered enough' part that really annoys me. Scottish football hasn't suffered at all. You have suffered a hell of a lot less than you should have. Any other new club would have had to reapply competitively to get into Div 3, and certainly wouldn't have been allowed a one-month window to sign players before the transfer ban kicked in.

sounds to me like nothing much has changed in their attitude to the rest of us, we all work together to get better deals and them and celtic claim 90% of it because their bigger than the rest.

 

sounds like a way forward.

I would have thought our game would be more attractive to sponsors if they knew it was clean and fair.  Somebody sponsors a crooked league they get tainted as well.

This is just to let their knuckle dragging support know they are defending the honours won with oldco.

 

I think that the SPFL & SFA have already made the decision & have gave sevco a heads up with it.

 

We all know Sevco is a Phoenix club, we all know the season oldco went burst the league with held prize monies from them.

We all know TRIFC should not be adorning the emblems & honours ( 5 stars) won by GRFC.

 

Scottish footballs guvnors( guvnors as in old cockney criminals) should be embracing this chance now to fully put to bed the oldco/newco/same team claims now & if "they" are indeed the same club, they should be handed maximum fines and be stripped of all

honours won with side letter players, if they are deemed to be a newco, then they should be told to remove all emblems & claims to any honours won with oldco, not that it's going to happen.

I hope they kept the receipt from D&P for those honours they bought from deidco. BDO might be making them a refund. I hope.

That was my first thought when I read their statement. Unbelievable considering they've never wanted to get together and help Scottish football in my lifetime. And regarding the sponsorship bit yes let's all pull together so Rangers & Celtic can Hoover up about 80% of it while the rest should be grateful for what you get.

Reading that statement, it's nice to see that ,after everything the old club as been through and everything the new club is going through, they realise their errors and are now showing some contrition.

Give them a choice. Either you're the same Rangers and we strip you of all titles won during the period EBT's were used, or you're  a new club, whose history began in 2012 and you can't lay claim to the oldco's history.

 

That would be far too easy for the SFA/SFPL though. I can hardly wait to see what fudge they come up with to try and sweep all of this under the carpet.

Rangers started using EBTs because Celtic had a bigger ground which would give them a financial advantage.

 

Had they not used EBTs then it is doubtful that they would have won the titles they did.

 

It has now been established that Rangers use of EBTs was illegal and they are due 70 million in back tax which will not be paid due to the liquidation of Rangers.

 

According to Rangers for the good of Scottish Football we should all just move on as there is no case to be answered.

 

Given the cringe worthy actions of the SFA then this is probably what will happen.

 

Whilst shoehorning the new Rangers into the Prem and first division was a red line for some non Rangers fans I don't think that failing to strip them off titles will provoke the same reaction from non Rangers fans so they will probably get away with it.

 

The big question will be whether the SFA does anything at all or if they will continue to rely on the now discredited judgement of the LNS enquiry.

Our game has to become more attractive to potential sponsors and partners if the finance levels required are to be generated but this can only be done if we present a coherent and united strategy. Therefore, a line must be drawn now if we are all to prosper.

 

It is our irrevocable belief that this Club?s history, including its many successes, is beyond debate. Rangers cannot countenance or accept any talk, attempts or actions designed to undermine what this Club has achieved throughout its long history.

 

So, as far as this Club is concerned there is no need for further SPFL consideration of court judgements or appeals. They should be saying it is time for everyone to move on and work together for the greater good of the game. Scottish football has suffered enough.

Many sporting bodies, athletes, players, clubs along with betting rings have been punished where they have disregarded sporting integrity and wilfully flaunted the rules. The list is long and getting longer by the day. The latest to come under scrutiny is Russia.

"Pressure is expected to grow for Russia to be expelled from world athletics after the publication of a key independent doping report in Geneva on Monday."

Rangers in whatever guise they want to portray themselves will come under the same scrutiny and be suitably punished for the now very obvious steps they made to attract players by using the EBT scheme in away that deliberately avoided paying the tax lawfully due.

Like many others who used unlawful methods which broke sporting rules and local tax laws they too will have any trophies and titles won taken from them during that period.

The fans and sympathisers of Old/New Rangers will just have to accept that this is what happens now to people who cheatem in the pursuit of glory.

I am now starting to think that given that there is so much media spotlight on World sport and the cheats/corruption within sport, that it would be an incredibly stupid move by the SFA to try and sweep this under the carpet. Ultimately if the SFA did try and bury this it could result in unwanted attention from media outlets who are not complicit with the SFA or Rangers.

The whole thing is a farce from start to finish. Lets not forget the organisation who will probably investigate this are the same corrupt bunch that held the fit and proper person test for king.

 

Could it just be coincidence that the whole tax case investigation in South Africa was started because King had falsified his taxable income and it has now been proven the same thing has occured for many many staff employed at rangers during the entire time he was on the board the first time round. 

 

I honestly hope UEFA are watching this situation closely and take action should the SFA decide to try and sweep the whole thing under the carpet as this has gone on too long and should have been dealt with promptly.
