Help needed...

I'm looking for any video footage or pictures from the last derby at easter road, specifically the dancing man on the penalty spot after elliotts equaliser! I was one of the fans celebrating with the players, I was chucked out the stadium then arrested two months later for breech of the peace! The police are trying to say that I was the one on the penalty spot so any help would be class. My court case is the end of this month so I really need your help! Gorgie rule!

Haha not yet, they can appologise to me as it was elliott and the players who came into the crowd hence the reason I went to celebrate with them!! I have emailed hearts to ask for pictures of the game so if they can help me out I will say sorry haha!

They need to provide evidence you were on the centre spot, you don't need to provide evidence you weren't....surely.

You would think but its been a farce from start to finish! I was kicked out the stadium, which I thought was punishment enough. Two months later I got a post it note through my door asking if I would give the police a call, phoned them and arranged to have a chat with them, they showed up at my work and hand cuffed me throw me in a meat wagon and arrested me with breech of the peace!! Had my first hearing a month ago thinking it would be chucked out but it wasn't and now I have a trail the end of the month! I'm no wanting to take any chances hence why I am desperate to get any pictures or footage of the guy on the penalty spot!

From what you say it would seem to me the evidence against you will be on video coverage, hence the two month delay as the video was analysed. I take it you have a lawyer, I assume like here he has a right to examine this type of evidence prior to trial.

From what i know they have no video footage, they said that the match day commander had body footage from his helmet cam but that wasn't submited at the first hearing. I dont want to take any chances as they are stamping down on this sort of stuff and i don't want to be banned for 5 years or what ever it is for celebrating a goal. Im pretty annoyed with hearts as well as i have been given a ban from them even tho when i questioned them they had no idea what i had done, suppose they have to be seen to be siding with the police but i would've liked some help from the club.

Would be equally as pathetic. But equally breaching the peace. (Which isn't much, if any, admittedly).

I've never heard of that helmet cam thing TBH. Sounds a bit iffy to me and, if there is CCTV footage your solicitor will know.

Would be equally as pathetic. But equally breaching the peace. (Which isn't much, if any, admittedly).

 

Honestly thought the same thing, i know i might sound a bit daft here by i never knew celebrating with the players was a breach of the peace! Going on to the park to confront someone etc then yes fair play but celebrating? Surely elliott could be in trouble as well then as he sparked the breach by leaving the field of play?

Sounds extremely thin on evidence :down: A good solicitor will get this thrown out.

I wasn't arrested till two months after the game, i was just thrown out the stadium on the day! Hopefully the fact that i was wearing a blue jacket, blue jeans and can be seen being escorted away by the stewards on the gravel and not the park should be enough to clear my name, hopefully!!

Surely your solicitor should be doing his job.

 

Breach of the peace is a crime where you have to be acting in a manner that is likely to cause offence or harm to others; what you describe wouldn't in my view be enough for this.

 

They also have to prove your guilt with either corroborated testimony or video.

 

I'd be questioning your solicitor on this. Never underestimate the value of a good solicitor, a lot of them don't give a stuff about the verdict and simply want to drag it out to maximise their legal aid fees.

Was equally surprised that nobody, club officials, stewards, police etc made any attempts to prevent him from repeatedly making inflammatory gestures towards the home support ? Maybe another reason why away fans shouldnt be invited to take part in this daft half time challenge in the first place...

Maybe but they don't have any video footage so i don't know what they are basing there case on? Also i though you needed an actual witness, someone whos peace was broken by my actions but there is no witness testomany! I have a previous charge relating to football so maybe thats why they think they have a case and is why im taking no chances by gathering as much eveidence to help clear my name!!

Breach of the peace or section 25 as it is known down south can cover anything as simple as spitting at the feet of some-one, calling them a name etc. It doesn't have to be racist or sectarian or even insulting, the fact that a person is assumed to be in the act or likely to cause a breach is enough. Running onto the pitch after your team scores a goal can be interpreted as provoking the opposition likely to cause a breach of the peace by their reaction to the provocation intended or not. You might find that if you plead not guilty you'll get a letter basically slapping you on the wrist and warning you not to do it again with the incident being recorded on file. Hopefully this will be the case and you will just have to restrain yourself at games in the future. Or get a seat further up the stand so you don't get too carried away lol! :thumbsup:

Were you in any establishments before the game that may have CCTV ? I know it's a long shot as these films get deleted after so long but you never know.

It may show you with the clothes you had on that day.

I do have a lawyer but i had to get legal aid so that might answer why my lawyer seems a bit of a douche! I have three of my friends ready to give eveidence if needed. The crown have submitted no video footage as eveidence so i dont know how they plan on putting there case against me!

I realise I am being contradictory with you, but I am trying to help. Your statement they have no video is obviously in error as they have the same facility to obtain the videos as shown on here. As a result of the riots in Vancouver the police here have been analysing the many videos from phones T.V's and other devices. The analysis has enabled them to refine the film and identify the offenders, it has caused numerous complaints because of the delay in laying charges, their, the police, answer by saying the delay strengthens their evidence. As has been said by others if you are paying for legal advice, ensure your counsel is researching all of those eventualities.

Panic not young man, youll get off with it no problem...Many years ago I was involved in,lets say a few football related court appearances and walked without even a fine on every one. Legal aid lawyers are still lawyers at the end of the day,and you tell him what to say in the long run. Best of luck :thumbsup:

Here's hoping mate!! The first hearing was four weeks ago and the crown submitted no other eviendence other than the statements taken when i was arrested. I think they have seen i have had previous and thought they would try save face and get a conviction. The only reason they came back and arrested me was due to a communication error between the policeman who ejected me and the match commander, i was supposed to be arrested on the day!!

Not sure by the sounds of it that you have actually spoken to a lawyer - for starters the hearing a month ago was a pre trail hearing - it's only to make sure both sides are ready to go to trial - that all witnesses have been cited, any undisclosed evidence etc etc - it is not a trial. If you were arrested two months after the event by prior arrangement can I ask why you didn't have your lawyer attend - by the sounds of it and if what you say is true this could (and should have ) all been sorted out at the interview stage. If the police have CCTV evidence in any shape or form your solicitor will have been given access to it - if it really is unclear then I would suggest the PF would not have considered going to trial on police evidence only - far to risky in this day and age. SEE A LAWYER ASAP..............

The youtube is pretty clear given what you've said, get that burnt to disc, taken into the lawyer's office and ask him to send it to the PF's. The matter should resolve.

 

Also, send a copy to Hearts to get your ban revoked, with an explanatory cover letter.

He fell out of the ball, got called a fat b@st@rd, fell over, got up and gave the GIUY sign to the Hibs fans, before being taken away by the police, all while his team were sitting bottom of the league and losing away to their most hated rivals.

The Hibs fans however, gave the same "We're-Not-Worthy" arm waves to some fat, greasy, retarded turd as we do to a Scottish Cup winning, top scoring ?1.6m midfielder. Hibs vs Hearts in a nutshell.

 

Also I think I saw a picture online somewhere of the guy who ran onto the penalty spot. IIRC he has a light yellow top on, can't really remember much. Did you seriously get thrown out just for celebrating with the players at the front of the stand? :down: I'm really hoping to got to the derby on the 2nd Jan but if the police are such Nazis I'll be lucky if I can stand while watching it.

Your first hearing would have been an interim diet, as said above it's just about establishing facts etc. The likelihood is that you will be found not guilty, but make sure your lawyer does his job.

 

And for Christ sake turn up at court dressed for the occasion, my previous appearance at court had me wearing appropriate attire and my co-accused in denims & T-shirt.

 

Needless to say I was innocent anyways, but it doesnt do any harm to show up looking like you are taking it seriously.

 

And don't wear a yellow t-shirt either!!!!

Also, how can they claim you were the boy on the spot, there must be plenty pictures of him going about. Despite not looking anything like him, I assume you were wearing something completely different from a yellow top? :mellow:

If I was you, I would appeal to Hearts about the ban they have imposed on you. You have been charged but not (yet) been found guilty of any offence and therefore, according to basic human rights principles, you are innocent.

 

If the courts impose a fine or ban that's different, of course.

 

Did you get a letter from Hearts and, if so, did it give you an opportunity to explain your side?

Unless you are between 5'9 and 6'0, have a skin head, number two to numnber 3 shaved head, a small bit of a beer belly and a yellow t-shirt - then it couldn't be you.

 

Christ I'm now wondering if that was me on the penalty spot. Deffo don't have a yellow t-shirt - so I'm safe.

Haha I have the worst hair cut in the world, total emo kid side shed haha!! I have sent my lawyer the video and asked him to send me any videos that they could have against me!!
