It’s a very important difference for the defendant. I read that Leslie was asked earlier about the not proven verdict - asked in effect if that actually meant he was not guilty. In practice I see the value of it but in legal terms I’m surprised it wasn’t kyboshed a long time ago

Yeah, I wonder if maybe it's possible to get tried again or something, otherwise I don't really see the point in this day and age where you're innocent until proven otherwise.

It should probably be acknowledged that in any other country this would equate to Not Guilty though.

It has value I reckon for any future cases. It's a verdict of 'good chance they did this crime but can't be 100% proven for certain.'

A possible wrong'un who should be on the radar.

It's more neutral than that IMO - "can't prove he did, can't prove he didn't"

Anywhere else, if you can't prove he did, he'd be not guilty by means of being innocent until proven otherwise. This is the way it should be, to my mind.

Not proven means if new evidence comes to light they can be tried again with the new evidence in submission.

Not guilty means no retrial, even with new evidence.

Pretty sure the law has changed on that. You can be retried after a bit guilty under certain circumstances I’m sure.

Just interested why you’d be surprised he’s an ex serviceman?

I've never seen it mentioned, despite his sons having careers in the media. Normally they would support / plug Armed Forces day etc .... or hear that their Dad was an ex serviceman.

First time I've seen a picture of him as well. He's mentioned in the article by name but nothing else about him, despite wearing his veteran badge.

This case has done us no favours. It's given that smarmy welt publicity when you just don't want to hear about him. It kind of massages his ego that people are still interested in him for whatever reason.

I know his Dad fairly well.

Big Hibbie and very nice guy as is his wife. I never knew he was in the forces but Les is a fair age now so it's very possible he was in a previous life etc

This'll probably help his ambition of getting back in the game through reality TV.  Sob stories all round!

Except I think the SNP got rid of double jeopardy a couple of years ago so not guilty does not mean you cannot get retried on new evidence. Could be wrong though.

He'd probably spend it on securing his VIP area in the night club until he's in his sixties. ,52 and still going to city centre night clubs. Mutton dressed as bam!

Is he the reason for the phrase 'Stott the ball'.  Hopefully that's a future headline if he ever gets found guilty.

What age should you stop going to city centre night clubs?

I think I stopped about when I was about 30 at the most.  Though if I had had the money for a VIP area, I probably would've stayed out till I was nearly 32. What age did you stop going?

Going from what I've heard I'm surprised he didn't offer up the "I was high on coke m'lud. Can't remember a thing" excuse

It made me laugh - I love it when people kick off like that on telly. Even Leslie found it funny

I can't believe how many times that ****ers been charged with sex crimes. I don't want to defame the guy obviously, as he could just be an exceptionally unlucky individual but it really does defy belief how often he's been in court on similar charges.

Notoriously difficult to prove.

See you next time John. And there will be a next time.

You might want to consider leaving your angry old dad at home too. Protesting too much comes to mind.

I think you are right.   Not Proven can still go back to court.

Not sure if I agree with it, as it means you could keep taking someone to court, until you get the result you want.

Kind of like the referendum.

Only if there is substantial new evidence can someone be re-tried for the same offence.

Doesnt have to be a not proven a not guilty can be re-tried as well.

So I suppose it is like the referendum/s. New evidence and all that. Perfectly justified imo.

I've had hands go up there when I've been going to Scotland matches and so on. Obviously, it's not the same in terms of the threat of sexual violence and so on but the double standard is irritating.

Same, think I’ve had stuff done or something smutty said pretty much every time I’ve worn it. It’s not even one person sometimes. If you watch them, they’re like a pack of wolves and think its hilarious. You see it all the time, especially at New Year. As you say, just another example of double standards.
