Sharpie
I am a bit curious about the Immigration hold, is he by any chance there on a Green Card. I have heard of situations where a person with a Green Card has left the Country for vacation, and on return finds that when they left they breached the conditions of the Card. Apparently in some cases you are not allowed to leave the U.S.A within a certain time of granting of the Card, when you do so the Card is cancelled and you are now basically illegal. Strictly conjecture on my part, but the long incarceration for a misdemeanor seems unusual even in the States.

Sharpie
I have just looked up considerations for incarceration in Virginia for misdemeanours. If the circumstances are as stated the incarceration is not for the misdemeanor, although that may have been the catalyst for the Immigration hold. As I commented earlier it may be worth for your own peace of mind to get the full story from your stepson, seems like his entry into the U.S is the key problem.|

The only information we have received has come from his ex-wife and his next door neighbour who was to pick him up at the airport and who incidentally, reported him missing the next day.He tried to get a visit but was told he had to be on a visitors list or something and that is made up by the laddie. It's just a mystery really,we think it has something to do with his ex as she is from a well positioned family and has been putting the laddie under pressure to allow her and her present husband to adopt the grandbairns. This added to the fact he is detained in a family type court/detention centre in Winchester V.A. The People's Chimp
Being serious for a minute, people are often banged up for minor "immigration issues" here as well; a breach of a student visa for a musician giving a paid performance for example, or an immigration officer doubting a relationship. And this can be on a whim, or on a tip off. The UKBA here love a dodgy tip off, even if from a very dodgy source, such as the estranged wife's fundamentalist brothers... My sister found love last year. Aw. So it was that my parents amazingly agreed for her girlfriend to come and spend six months here, living with them. Remarkable, I know - but hardly a crime, is it? So my sister's girlfriend travelled from Chicago to London, arrived at immigration... was detained for 12 hours, then turned back. And why? Because they'd decided for no apparent reason that she was here to look for work. Did they contact my parents, who could act as guarantors for her? No. They permitted her one two-minute phone call to my sister - then sent her on her way. She's now barred from trying again for at least two years - and as any prior refusal of entry is always noticed by immigration officials, in reality, it's much longer than that. And when I returned from the US back in January - it'd been the first time I'd flown abroad in seven years - I found Heathrow akin to Fort Knox when I got to passport control. Far, far more heavy handed than I could remember: suspicious, threatening, and very unnerving. I think both countries are as bad as each other - and I deplore the way in which complete innocents are treated so disgracefully, purely because of a political agenda which has become shamefully skewed and the complete opposite of civilised over the past decade.
