It's more neutral than that IMO - "can't prove he did, can't prove he didn't" Anywhere else, if you can't prove he did, he'd be not guilty by means of being innocent until proven otherwise. Only if there is substantial new evidence can someone be re-tried for the same offence. Doesnt have to be a not proven a not guilty can be re-tried as well. So I suppose it is like the referendum/s.
