As of today, if you plan to enter the USA on an ESTA (visa waiver program), then you MUST have an ePassport (biometric) document. It is very unlikely that anyone still has the older, non-biometric, passport as the new docs have now been issued for over 10 years. However, it is still possible that someone may have 6 months to a year left on their old passport, and they are planning a trip to America.
