How is it possible to ACCIDENTALLY do something like this ? Now these folk who've already had their lives ruined will be getting pestered by legitimate financial companies & fraudsters looking to get them to invest their payout in some scheme. Surely this should result in the PO getting a hefty fine from the ICO .... with the Govt making sure that the fine gets deducted from the PO directors' bonus pot. Quote

He thought that thousands more had no issue so the system was robust. Quote
Footballfirst Posted June 21, 2024 Posted June 21, 2024 I had a look at Thomson's witness statement. In his 83 paragraphs he used "robust" 23 times and "systemic" 19 times. Quote
Victorian Posted June 21, 2024 Posted June 21, 2024 Did this guy really think his own involvement could be mitigated by a last man standing type of defence like this? That he could convince the world that it really isn't the thing it has been shown to be? Baffling. Quote
Footballfirst Posted June 24, 2024 Posted June 24, 2024 The whole of this week's evidence sessions (Tue-Fri) are devoted to Gareth Jenkins. Given his key role as an "expert" on Horizon and his contribution to the prosecution of multiple SPMRs I suspect that there will be a good deal of information revealed about his interaction with the PO legal team. stuart500 Posted June 25, 2024 Posted June 25, 2024 Gareth Jenkins has his chance to take down quite a few 'top dogs' in Fujitsu and POL. However in view of self incrimination implications this might turn into more of a 4 day " no comment" session. Should be interesting though. Quote

Hagar the Horrible Posted June 25, 2024 Posted June 25, 2024 Well you cant say there is no flies on Jenkins Quote
Hagar the Horrible Posted June 25, 2024 Posted June 25, 2024 Before the evidence begins, Sir Wyn Williams, chair of inquiry, tells Jenkins that he has a right to decline to answer a question if there is a risk the answer would incriminate him. Jenkins is told he must make the chair aware if he does not intend to answer a question on those grounds. We already know Jenkins is under police investigation and his lawyers have unsuccessfully petitioned the inquiry to rule his evidence can't be used against him. Quote
Hagar the Horrible Posted June 25, 2024 Posted June 25, 2024 Jenkins does not accept all of the findings in the Alan Bates court case, he does not know what bug caused the problems. Quote
Hagar the Horrible Posted June 25, 2024 Posted June 25, 2024 Jenkins says he can't remember receiving the letter and only became aware of it when the police investigation into him began in 2020. Beer pauses to "help" Jenkins and warns him that discussing his conversations with solicitors could be read as him waiving privilege in those matters, meaning the inquiry would be entitled to ask about those conversations more broadly. The lawyers tells him he can waive that privilege if he wants to "but doesn't want him to do it by accident". Playing the I cant remember card now, nearly caught himself out on waiving privilege, Beer legally warned him so if he does so again, it is game on Quote
Hagar the Horrible Posted June 25, 2024 Posted June 25, 2024 I have been an expert witness lots of times, it is very boring, but if you have anything relevant to the case full disclosure is sacrosanct, You always answer question from your statement, that the defence usually asks . It you stick to the facts, offer no opinion, you get an easy time, but sometimes the Judge asks really awkward questions . Jenkins states he had no knowledge of his understanding what an expert witness is, Then he is not an expert witness, he has already belittled his term as "Expert" Quote

I've worked on some the biggest global rollouts and it was the case every time that support teams ( 3rd line) had' superuser status' and could perform remote access sessions ( RAS) knows my PC - but these guys were supposed to be vetted and restricted in numbers. Problem was, the lawyers didn't understand this until it was too late : they'd prosecuted/jailed hundreds of people by then. But they understood the legal implications and the career ending that would follow for them. That's why you never heard from the PO head of IT - she was totally marginalised. But she knew and she understood very well what was going on and what the implications were. But she kept her mouth shut Her predecessor was even worse- an arrogant lying pirck. He kept his mouth shut too. Ultimately the PO senior leaders and board was deceived by their own lawyers. The lawyers made sure the IT dept never spoke to anyone directly and PO never asked wtf was going on in their own IT dept. The lawyers literally ran the PO to save their own skin. Quote
