I toiled with that conundrum last time but resolved it with the logic that they buy an ends-worth of tickets from us, so it evens out. Having said that, 2 x £34 hurts, but is instantly forgotten when we're still singing to their thousands of empty seats a mere minute or so after full-time (mind you, it's difficult to tell when this photo was taken as they traditionally dress up as seats):-

That's true. I well remember having a chuckle in Baker, California at the sign, "No shirt, no shoes, no service."

 

They tried that in Lochend, and the environs, so I'm led to believe, but had to cave in as trade dried up. 🤭

Not my point, you can refuse service, you don't have to give a reason, you can refuse access to your premises .

You can if you want to.

Yes and no.

Very unlikely tbh.

 

It's contract law- offer acceptance etc.

 

You are under no obligation to accept contract.

 

For example, you can let a person onto your shop but refuse to serve them.

If they then steal they are breaking the law.

You are under no obligation to serve them.

The police will be on your side.

The law is on your side.

 

In terms of premises it is a bit more grey, but you can say to someone you are free to be here but we will not serve you.

Once you establish that you can then ask , why are you here?

You can then phone the police to remove them.

 

It's really easy tbh.

In terms of covid.

 

Under the umbrella  H&S act all employers have a duty of care to their employees.

 

Any covid rules followed by staff and enforced by an employer will be backed up by that act. Especially when issued by the government.

 

In fact, any employer that values it's employees will back up their employees on this.

Yeah that looked like a great night to be there, I used to get a student ticket for a good few years, no skin of our TO staffs nose 😆
I hadn’t seen us win for a few games there and we are unbeaten since I’ve not been so I think I will keep that up 😂

The reason we find it difficult to enforce restrictions in this country. 

Everyone cares about their rights but not all care about their responsibilities.

Hospitals I work in are still very low or empty with Covid patients.

Wearing a mask or not is not a protected characteristic. 

 

And again, you do not need to give a reason. 

If you do not give a reason then you are not discriminating. 

 

The key thing is you do not need to give a reason. 

I understand the difficulties in this but you could stick bouncers on the door of any premises and refuse access. 

If they have access you can refuse to serve them. 

 

You do not have to say anything other than "I'm not serving you" or "I'm not letting you in". 

 

Pubs and clubs do it all the time.

But my father in law was in hospital with a suspected stroke and waited a full day for a ward as they had no space in the wards. 

 

He went in on thur, got moved to a ward Fri afternoon. 

Wards were full on thur.

Hospitals are normally stretched at this time of year anyway. I've not heard of any hospitals in the UK at breaking point full of covid sufferers though. Not that I pay much attention to the on the job gossip.

To be fair the only creep of restrictions recently has been in England.

The mask wearing doesn't discriminate against disabled people either.  There is clearly an exception within the guidance. 

 

You can refuse access or service to anyone. 

 

If you refused access to all disabled folk and/or all black folk you may find yourself in bother at some

point, but you can refuse service to anyone. 

 

A simple fact that the anti maskers and anti covid folk don't like is that although no one can force them to be vaccinated and wear masks business and services are also free to refuse serving them. 

It is their right. 

That freedom works both ways and any employer protecting it's staff is not only within it's right it is also quite well protected by law. 

 

No hypothetical situations or cries of discrimination will change that.

If you're refusing service to anyone not wearing a mask without further enquiry,  as you say they are entitled to do, that is an absolute rule.

I wonder if the lack of fans has contributed to Monchengladbach losing 0-6  in the first half to Freiburg.    I've never seen a first half result as bad in the German top league.

It is an incredible scoreline. It was 0-5 after 24 minutes. Gladbach fans will not be best pleased - they also recently got stuffed in the derby against Köln, a fixture they habitually dominate. Crazy season for Gladbach - I think they also beat Bayern 5-0 in the cup.
