This is why I say it would most likely be settled by arbitration. It might well be construed as constructive dismissal, but I wouldn't take it as a certainty just because it looks like that to the untrained eye. None of us know what was written into Stendel's contract or accepted when he was offered/agreed to accept garden leave.

Who would know that he's asked for 24 hours and the club have said no?

Stendel, Stendel's agent, Stendel's wife, the relevant people at Hearts.

A scunthorpe fan isn't going to know without a decent connection.

Is this yet more money being thrown at this deal. Going by the Daily Mail article, it seems Ann may have been caught out on this if we're having to pay compo to Barnsley now. I would have thought that most clubs having put their manager on gardening leave would welcome a club coming in and taking him off their payroll. I hope I'm wrong but it is her first venture into this arena and yet again it appears we'll be paying more than we should. Having no Plan B is costing us our negotiating position as well i believe. It'll all come out in the figures but it's yet more unbudgeted expenditure.

Doubt if we have no plan b. The time this has all taken and the rumours of interviews points towards there being a back up I think.

surely she would have done due diligence on this. Plan b is probably Robinson or McCann

I reckon Plan B will be narrowed down now as if you're in a job like Robinson is I'm not sure he'll be too enamored at being second in line after this prolonged process. But the unemployed ones like McCann or Pressley will still jump at an offer I expect.

Hearts have apparently agreed personal terms - that's the hard part done. I don't see Hearts engaging on this if they didn't already know what the worst case scenario would be re compo. Your point about  unbudgeted expenditure ? So what ? That's what happens when you sack a manager.  It's nothing to do with lack of experience.

He also said his brother would NOT be joining Stendel's team at Hearts. So that takes away the possibility that he has ITK information from inside the negotiation room.

Yes of course it is but I just don't like seeing us over paying for anything unnecessarily. Let's not forget this guy has just been "sacked" but we're having to pay compo. Very unusual.
