A better day for OP with 3 neighbours saying they didn't hear a woman screaming.

 

Still on track for a manslaughter verdict though. Defence saying will finish in a week.

OP begins his Psychiatric Evaluation today. Prosecutors accuse him as a volatile and paranoid gun nut.

 

Expected to last a month.

 

He could face 25 years if convicted of premeditated murder.

He may well be a paranoid and volatile gun nut.

 

Still doesn't mean he didn't think he was shooting at an intruder.

Tis true, but if he heard something, like someone breaking in, you'd think he would have asked Reeva if she heard it as well and waited for her response.

 

Why would you shoot at someone, intruder or not, without seeing their face ?

 

Why go towards the toilet, where he believed the intruder to be and so on the attack as it were. What were they going to burgle in the toilet ?

 

Why not wait until they come out the toilet then question / threaten them ?

Because he probably feels more vulnarable as a handicap with no legs.

I reckon he knew it was her but didnt mean to kill her. I think im in the "trying to blow the door down in a fit of rage" camp.

Prosecution on now / defence probably tomorrow.

 

Sky News covering it.

 

Has to be one of the longest trials in history.

It's interesting to see the difference between barristers' performances in jury trials, and the Judge-only system in South Africa.

 

Neither counsel has to play on the emotions of twelve members of the public.

 

They're talking entirely to the Judge, who already has the jist of both arguments because she's been given the summaries in hard copy, and who cares mainly about being supplied with reasons to come to a watertight conclusion.

 

I don't imagine Roux and Nel can make much all that difference to the outcome at this stage - everyone's just going through the motions because the court system requires it.

 

It gives Roux the chance to impress his client with a flashy performance.

 

Masipa comes across as sensible and a stickler for detail - all this Roux grandstanding is for another audience than her, I feel.

 

Michelle Berger's evidence is very important. She could never have known her description of the shots would match the ballistics evidence.

I didn't see Assessors or Judge making many notes during Roux's argument.

 

Moves are already in place for an immediate appeal of anything other than a complete acquittal.

 

Even if Oscar is convicted and sentenced to 25 years, he will be OUT on bail, again, until the conclusion of the appeal/ re-trial.

 

South Africa justice at its utter worst.

Am I right in saying there are four possible outcomes?

 

- Premeditated murder

- Unplanned murder

- Culpable homicide

- Not guilty

 

He can't be found not guilty

My guess;

 

Not Guilty of premeditated murder.

 

Guilty on firearm charges - outcome, fine.

 

Guilty of culpable homicide - 1 or 2 year sentence given "his circumstances". Vulnerable, legless man in fear of his life during a burglary.

 

Just feel they can't prove beyond all reasonable doubt what we all think happened that night.

judge has dismissed a lot of state evidence including arguing beforehand (no evidence this took place), phone messages (just normal in relationships) and food in stomach (science is inconclusive).

 

But judge going through OP thinking in shooting didn't sound good for him ie gun just went off.

Think she's working to decide that he had no intention to kill.

 

To be honest I can kind of see where she is coming from. The boy is a bit unhinged and weapons obsessed, they have a huge fight and she runs into the bathroom so he shoots the door to scare the shit out of her. Not being rational enough at the time to consider that the chances are she'll be shot, then having a "WTF have I done" moment.

 

The whole intruder thing is still BS though.

I find it quite weird when people complain about the outcome of murder trails etc.

 

Do you know more than the judge? The person who has been provided with and has thoroughly reviewed all the evidence?

The press are reporting that this is the sentence the judge will pass.

She did say it didn't make sense how Steenkamp didn't respond when he shouted to call the Police.
