how can a club run up a debt to the tax man of 75m and just have 10 points deducted and start all over again just because Sky says so, my dish will be returned toot suite

Basically as far as I'm aware they have 2 options.

 

1) CVA where >75% creditors would need to agree to a reduce payment plan. 10p in the pound etc. IF (a big IF considering HMRC would be one of these creditors and most likely the only one who's decision matters) but would allow them to continue on as is.

 

2) Option 2: Restart as a new company. This would mean reapplying. Starting in division 3 etc.

Portsmouth have also filed papers for Admin today. Their biggest creditor is also HMRC so they will have to be consistent in their approach to both Clubs. Suspect that many other clubs are close to a similar situation and will be watching with interest. I cant see HMRC deciding to allow the football industry to renege on their tax evasion/avoidance activities.

In Rangers case there is a moral exposure as well. If they have avoided ?75m of tax in order to pay players they couldnt otherwise have afforded, why should football or the tax man give them a break?

That depends. If they come out of administration as the same entity, their license to compete in Uefa competitions would be issued by the Scottish Football Association, provided they had exited administration by the end of March.

 

Failure to exit administration by then would mean they would not have a license and wouldn't be able to compete in Europe next season.

 

If they come out of administration as a different entity, their license would lapse and they would have to apply for a new one. It would then be up to the SFA and Uefa to decide if a new license can be granted

There is no way that the ConDem government, or the Treasury, will allow HMRC to settle for pennies in the pound when services, pensions, and benefits are being cut left, right, & centre. HMRC will also want a strong precedent when they start going after City Bankers and EPL teams who have, allegedly, used the same dodge.

Hmm - as much as we might like this to be true it would appear Vodafone and Goldman Sachs (to name a couple) got let off or made deals.

A: There wasn't any.

 

 

Totally different situations, so no real comparison can be made of the two very different situations.

 

As RFC have the assets to pay the bill in full then they (HMRC) have no need to come to an agreement for less than the court decides they are due.

Yes. This was their policy at the time. A ludicrous policy but that is what it was.

 

It is now in the public eye and rightly condemned so less likely to be repeated.

Portsmouth have the benefit of the Football Creditors rule to fall back on. Also it was public knowledge since CSI went into Administration in November about Portsmouth being on borrowed time and running out of money by the end of december (or there abouts). They will have the adminstrator lined up already etc.
