Sainsbury's parking tickets

Sorry if this has been posted before, what's the crack with this, there was 4 guys going round Sainsburys car park today with there pads taking photos of number plates, we got a ?60 ticket for staying more than 2 hours.

1 guy tells me that if it's a print out from a ANPR machine that's a maximum time car park and could be legit.

Another chap tells me that only council ones and NOT private ones count.

I would rather pay the ?30 in the next 2 weeks rather than paying whatever 2 months down the line, Cheers for any help in this and sorry if it's been posted before.

Sorry to hear this but why does anyone park in a car park that makes it clear you should not park there more than 2 hours.

 

There is plenty of free parking surrounding Tynecastle and there really is no excuse for parking in Sainsburys.

Don't normally park in Sainsburys but was running late for the game today so knew I'd be in/out the car park within 2hrs. Never noticed any attendants or anyone with tickets mind.

I got one in March last year and they've done nothing other than send letters ever few weeks reminding me about it.

I had a similar one from Aldi. ?90 or ?45 if I paid up within two weeks. I ignored it, got a few threatening letters and eventually they went away. That was aboout a year ago.

 

Google the subject and you'll get some useful advice. One thing is that maigistrates/ Sherriff courts don't look kindly on extortionate or unreasonable demands, eg multiples of local authority parking charges.

I don't think Sainsbury's have cameras so they'd have to prove what time you arrived at and what time you left at...........taking snapshots on an i pad won't prove that.

Don't pay and definitely don't respond in any way shape or form. If they do not have a name of who parked the car they cannot take anyone to court - even if they have the name of the vehicle owner.

 

They will more than likely send loads of threatening letters / then nice letters saying they will settle for a lower fine / then phony legal looking documents saying you are going to go to court - but just ignore them all. The letters won't be sent recorded mail so there is no proof you ever received them.

 

These companies play on your fear. I would agree with the companies if they truly had a parking problem but they constantly give you fines in half empty car parks - it is a money making scheme. Even ones that have made it to court they have lost due to the ridiculous cost they claim for parking.

 

I have had a few from car parks I never realised had parking fines - and got the usual letters then after 6 months to a year they gave up. 

 

Only council ones are the ones you need to worry about.

Prove what to whom? No court in the land nor the police are interested in this sort of thing.

I think in the whole history of Scotland only something like 2 people have ever went to court and lost.

Bin it they can't touch you legally in the UK. You'll get about 3 million threatening letters though.

 

They work off a certain percentage of people who have had a ticket paying them.

it's only the police ones that carry any serious clout that i know of , i have had 3 council ones over the years and never payed any of them for various reasons , they do go up if you do not pay but eventually they do realize that you are not going to pay and they stop sending them well that is my experience with them . i don't know if they have not got the power to take you to court or what but that is my take on it .

Cheers for that guys, the thing is when you leave for footy at 10 and get home at 21.00 Sainsbury's is very handy and We would be happy to pay if you stay for 3 / 4hours so why don't they just put meters in car park.

Presumably because they built the car park for customers, and don't want to deter them by putting meters in (potential hassle), or the cost of installing/maintaining them.

In principle I agree with you, but imagine if you were shopping and you could not get a space and you found out it was supporters cars....... I'd lose it.....

I think every now and then sending someone around to let down tyres or key scratch offending cars would do the trick. After all as some have said there is no CCTV and there would be no practical come back for the "victims".

There's a private car park where I live and each space is clearly marked with the flat number. I technically pay for the parking space I get. But because it's privately owned then random folk just park in it all the time because they know they'll get away with it without any consequences. It is desperately scummy and selfish behaviour. Anyone that parks in my space I've began to park directly behind them, essentially blocking them in. They know my flat number so if they want out then they can come up and ask nicely, cretins. Just stop being an arsehole and park somewhere else FFS. Complete laziness.

If you let down their tyres, best make sure there is a air pump shop near by, or else the two hours could be a real challenge.

The fines aren't criminal, but technically if you don't pay it they can take you to a civil small claims court! It's a very easy loop hole to get out of and in reality they never ever take anyone to court, they just rely on the people who unwittingly pay the fines. It's a bit of a scam - they could technically try and take you to a small claims court, but even if they did they wouldn't have a leg to stand on and it would cost too much money so they won't. Their problem is they have no way of proving who the driver of the car was that parked it. Only the Police have that power under Section 172 of the Road Traffic Act 1988.

 

That's from a cop. Take what you want from that.

Tell you what, there's a legitimate reason for staying too long though - park, let the air out, take photos when you get back to prove it. Thanks uncle Francis!

Where I live, we have allocated spots in a private car park. There is an older couple who own two properties in the building but have one car. Occasionally, someone parks in the other spot, and the boy goes mental. Blocks the car in, leaves radge notes etc.. I've been quite concerned on a couple of occasions that he's gonna get involved in a proper fight as the owners of other vehicles have become quite irate. Understand where he is coming from, but no worth getting assaulted over (particularly as he never uses space anyway).

 

But then there is one visitor space in the car park. This old couple actively monitor it (in between sherries) and actually harass folk they think are abusing it (e.g. actual visitors who are there maybe a day or two). Does my ****ing nut in, as they often come to my door to discuss and enlist my help...despite me making it clear I am totally indifferent to the visitor spot being used by...visitors.

 

You're better off parking it at sainburys.

The letter will say you broke the parking contract,by staying more than 2 hours, ignore it, a sign on a wall isn't a contract. It's not legally enforceable like police and council parking tickets. Don't write back, just don't engage at all.

I don't do it personally, but I'd actually rather folk parked there than all the on street parking spaces that are available. Edinburgh's shitey streets aren't really designed for too many cars parking up.

 

Used to live in polworth and parking was a nightmare every day, never mind match day.

The ticket is for a breach of contract, it is nothing to do with the police. I got one with the same 'pay early it's X amount, after 14 days it's Y' and so on. I have a copy of the letter I sent them, you can get pro-forma letters from the internet, and they dropped the case straight away. They have no real power in Scotland, they can have all the signs up they want but in most cases they'll back down as soon as you send the letter.

Parking have only prosecuted 3 people in hospital car parks in last ten years

Don't pay it , it's not illegally wrong to park in a supermarket car park it's just their " rules" anywhere in gorgie or Dalry on a Saturday or Friday night is free parking

Francis Albert, Jeso your a hard man, I followed Hearts since 1958. Sold Capital cash line tickets for years, ?500 in for Gorgie stand, Donations since the start for FOH, Season ticket, years of heartache, park in Sainsbury's for 3 hours now guys want to let our tyres down or scratch the car. The train is near ?60 return, Jesus a could walk down the road and watch Caley, but we are JAMBOS HHGH.
